OUR TERMS AND CONDITIONS
These Terms and Conditions (“Terms”) govern the relationship between DragonStone Technologies (“we,” “us,” or “our”) and the Client (“you” or “your”). By engaging our services, you agree to be bound by these Terms.
1. General Terms
1.1 DragonStone Technologies is a locally owned and operated business serving Greenville, Ohio, and surrounding areas.
1.2 These Terms apply to all services provided by us, including but not limited to: computer services, photography, consultation, delivery, and related technical or creative work.
1.3 By signing an invoice, service agreement, or otherwise providing explicit consent, you acknowledge you have read, understood, and agreed to these Terms.
1.4 If you are engaging our services on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms.
2. Service Agreement & Authorization
2.1 All work begins with a consultation and/or written estimate.
2.2 No work shall commence until an invoice or service agreement has been acknowledged or signed by the Client.
2.3 The Client authorizes DragonStone Technologies to perform all necessary actions, adjustments, or installations to fulfill the requested service.
2.4 The Client affirms ownership or authorized use of any equipment or property provided for service and releases DragonStone Technologies from liability for issues arising from lack of such authority.
3. Custom Build Policy (Computer Systems)
3.1 All computer components are purchased at prevailing market prices. Component costs must be paid in full before ordering.
3.2 New components are standard unless otherwise agreed in writing. Used parts, when requested, will only be sourced from reputable retailers.
3.3 Build specifications and invoices are documented in writing for Client approval prior to commencement.
3.4 All written reports, software configurations, scripts, and designs created by DragonStone Technologies remain our intellectual property unless explicitly transferred in writing.
4. Warranties
Component Warranty
4.1 Individual hardware components are covered solely by the manufacturer’s warranty. The Client is responsible for warranty claims, though DragonStone Technologies may assist if we performed the build.
Build Warranty
4.2 DragonStone Technologies provides a four (4) year diagnostic and repair warranty on custom-built computer systems.
4.3 This warranty covers assembly workmanship and operating system installation.
4.4 This warranty does not cover:
Physical damage, misuse, neglect, tampering, or modification.
Power surges or electrical failures.
Third-party software/hardware not installed by us.
Data loss of any kind.
Environmental factors (e.g., water, fire, smoke).
Pre-existing conditions present prior to our service.
5. Data Recovery & Client Responsibility
5.1 Data recovery is offered on a best-effort basis. No guarantee of success is provided.
5.2 The Client is solely responsible for maintaining data backups before any service.
5.3 DragonStone Technologies is not liable for:
Partial or failed data recovery.
Data corruption during recovery attempts.
Consequential damages arising from data loss.
6. Photography Services
6.1 Scope – Photography may include private sessions, event coverage, astrophotography, macro/landscape projects, product/commercial photography, branding, and corporate headshots.
6.2 Client Responsibilities – Clients must arrive on time, secure venue permissions, and for minors, ensure parental/guardian consent.
6.3 Editing & Delivery –
Clients may choose RAW/JPEG delivery or edited photos.
Edited photos include adjustments to exposure, color, and composition. Extensive retouching may incur additional fees.
Standard delivery timelines are 5–7 days for RAW/JPEG and 2–4 weeks for edited work.
6.4 Usage Rights & Copyright –All images remain the intellectual property of DragonStone Technologies unless otherwise agreed in writing.
Private Clients receive a personal-use license only.
Commercial Clients receive a commercial-use license as defined in their invoice. Exclusive rights require a separate written agreement.
Clients may not resell, alter, or redistribute images without permission.
6.5 Cancellations –Cancellations >7 days prior: deposit refundable or transferrable.
Cancellations ≤7 days: deposit is non-refundable.
If DragonStone Technologies cancels, all deposits are refunded.
6.6 Liability (Photography) – We are not liable for accidents, weather, or venue restrictions. Our liability is limited to the total amount paid.
6.7 Archival – Delivered photos are archived for 6 months; after that time, availability is not guaranteed. Clients are responsible for safely storing delivered files.
6.8 Model Release – Unless opted out in writing, DragonStone Technologies may use non-sensitive images for portfolio or promotional purposes.
7. Returns & Refunds
7.1 All custom builds, photography sessions, and service fees are final and non-refundable.
7.2 Refunds or adjustments may be considered only if no work has commenced and no components have been ordered.
7.3 Component defects are handled exclusively through manufacturer warranty processes.
8. Payment & Collections
8.1 Component costs must be paid upfront.
8.2 Service, labor, and delivery fees are due upon completion unless otherwise agreed.
8.3 Deposits are non-refundable once work begins or parts are ordered.
8.4 In the event of non-payment:
DragonStone Technologies may suspend services and hold Client property until balances are settled.
Outstanding balances beyond 60 days may be referred to collections.
Clients are responsible for reasonable collection costs, including attorney’s fees.
9. Delivery & Property
9.1 Delivery services are limited to a 50-mile radius of Greenville, Ohio. Extended delivery requires prior agreement.
9.2 Any property not collected within sixty (60) days after notification may be deemed abandoned and disposed of at our discretion.
10. Disclaimers & Liability
10.1 We are not responsible for pre-existing conditions, incompatibilities, or issues beyond our control.
10.2 Force Majeure – We are not liable for delays or failures caused by natural disasters, power outages, internet disruptions, labor disputes, or government actions.
10.3 Liability Limitation – To the fullest extent permitted by law, total liability is limited to the amount paid for the specific service rendered.
10.4 We are not liable for indirect or consequential damages, including lost profits, lost data, or business interruption.
10.5 Right to Refuse – We reserve the right to refuse service for suspected tampering, unsafe equipment, or abusive behavior.
11. Data & Privacy
11.1 All client data is treated with confidentiality and will not be shared without written consent, except where required by law.
11.2 For transparency and education, DragonStone Technologies may record certain services (e.g., maintenance or cleanings) with Client consent.
11.3 Clients may opt out of any media recording.
11.4 Photography clients may separately opt out of promotional use of their images.
12. Additional Provisions
Modification of Terms – We may update or amend these Terms at any time; the version in effect at the time services begin will apply.
Severability – If any clause is found invalid, the remaining provisions remain enforceable.
Entire Agreement – These Terms, along with signed invoices and service agreements, constitute the full agreement between DragonStone Technologies and the Client.
Indemnification – Clients agree to indemnify and hold harmless DragonStone Technologies, its employees, and affiliates against claims arising from misuse of services, equipment, images, or third-party disputes.
13. Governing Law & Dispute Resolution
13.1 These Terms are governed by the laws of the State of Ohio.
13.2 Both parties will attempt to resolve disputes amicably through negotiation or mediation.
13.3 If unresolved within 30 days of written notice, disputes may be brought in a court of competent jurisdiction in Darke County, Ohio.
Scope of Photography & Videography Services (EXTENDED)
DragonStone Technologies provides photography and videography services for private, premium, and commercial clients. Services may include portrait sessions, event coverage, astrophotography, landscape/macro, product photography, commercial branding projects, highlight reels, product videos, event videography, and creative or promotional video work.
Client Responsibilities (Media Services)
The Client is responsible for being on time for scheduled sessions. Delays may reduce the length of the session without refund.
For events, the Client is responsible for securing all necessary venue permissions for photography and videography.
For minors, a parent/guardian must be present and provide consent for photographs and video recordings.
Editing, Delivery & File Formats
Clients may choose between delivery of unedited media (RAW/JPEG images or unedited video files) or professionally edited/produced media (as per the signed invoice or service agreement).
Editing includes: exposure, color, sharpness, stabilization (where possible), sound syncing, and artistic style. Extensive alterations (object removal, body modification, advanced VFX, or third-party soundtrack licensing) may incur additional fees.
Delivery timelines will be stated in the invoice:
Edited photos: typically 2–4 weeks.
RAW/JPEG delivery: typically 5–7 days.
Edited video: typically 3–6 weeks, depending on length and complexity.
Raw/unprocessed video files: typically 5–10 days.
Copyright & Usage Rights
All photographs and video recordings remain the intellectual property of DragonStone Technologies unless otherwise agreed in writing.
Private Clients: Granted a personal-use license only (e.g., printing, social media, personal sharing). Not for commercial use or resale.
Commercial Clients: Granted a commercial-use license as outlined in the invoice. Exclusive licensing (no re-use by us) is available at additional cost.
Clients may not resell, alter, or redistribute images or videos without written permission.
Cancellations & Refunds (Media Services)
Cancellations made more than 7 days before the scheduled session: Deposit may be refunded or applied to a future session.
Cancellations made less than 7 days before: Deposit is non-refundable.
If DragonStone Technologies cancels for any reason, all deposits will be refunded in full.
Liability (Media Services)
DragonStone Technologies is not liable for accidents, weather delays, or venue restrictions that prevent or limit photography/videography.
We are not responsible for missed shots or footage due to restrictions imposed by event staff, venue policies, or interference from guests.
Current limitations of equipment (e.g., lack of advanced stabilization tools such as gimbals) are acknowledged as part of the service scope, and Clients accept these limitations when booking.
Our liability for any photography or videography-related claim is limited to the total amount paid for the session/project.
Archival Policy
Media will be archived for 6 months after delivery. After this time, we cannot guarantee availability of backups.
Clients are responsible for safely storing their delivered files.
Model & Media Release
Unless otherwise stated, DragonStone Technologies may use non-sensitive images or video segments for portfolio, marketing, or educational purposes.
Clients may opt out of promotional use by written request before delivery.
